Wedding & Special Event Contract Agreement

Payment

Upon acceptance of the initially proposed floral & décor design plans and pricing, a $500 retainer payment will be required to secure the services of Larkspur & Leo. This retainer payment is non-refundable and will be applied to your final bill. 50% of the remaining balance is required no later than thirty (30) days prior to your event date and is also non-refundable. If the 50% payment is not made thirty (30) days prior to your event date, all preparations will be halted until payment is made. 100% of the remaining balance must be paid two weeks (or fourteen days) prior to your event date, and is also non-refundable. If final payment is not received two weeks prior to your event date all preparation and production will be halted until payment is made. Certain exceptions to these payment terms may apply at the discretion of Larkspur & Leo.

Payments may be made by cash, personal check, certified check, money order, Zelle, debit or credit card.  

Debit or Credit Card: payments may be made directly upon receipt of invoice. Invoices will be emailed on payment due dates, and/or at your request.

Zelle Payments: Larkspur & Leo's Zelle account can be found by email, larkspurandleo@gmail.com.

Cash, Check, or Money Order: payments may be made payable to Larkspur & Leo Artisan Floral Design and, if submitted by postal mail, sent to 817 Hillandale Drive, Antioch, IL 60002.

Other payment methods may be accepted at the discretion of Larkspur & Leo.

Delivery & Setup

Larkspur & Leo is happy to offer delivery to any location up to a 60-minute drive time from its studio location, at 200 N. Milwaukee Ave, in Lake Villa IL, per Google Maps. Certain exceptions may apply. Delivery charges start at $90.00, plus $2.50 per mile from the studio location to the event location. This delivery charge is subject to change based on delivery location, number of delivery stops, and load, and at the discretion of Larkspur & Leo.

 

If setup is required, an additional fee will apply, at a minimum of $75.00. This fee is subject to change based on the amount of setup that is required, and at the discretion of Larkspur & Leo. If a return trip, or trips, are required for tear down and/or pick-up of floral and/or rental items, there may be an additional fee up to the total amounts of the delivery and/or setup fees.

*Delivery and setup services are not available for events with a total order value under $1500. Certain exceptions may apply, at the discretion of Larkspur & Leo.

 

The exact fees associated with delivery and setup, for your event, will be listed on the most current version of the design plans.

Modifications

Modifications may be made to your order thirty (30) days or more prior to your event date. Certain exceptions may apply, and may also be subject to additional charges at the discretion of Larkspur & Leo. Floral additions will only be accepted until one week (7 business days) prior to your event date, and any additional charges incurred will be added to your final balance. Certain exceptions may apply.

Substitutions

Larkspur & Leo reserves the right to make substitutions to any and all florals in the event the flowers and/or foliage received, or grown, by our suppliers are not of the quality suitable for your event, or if they are, or become, unavailable for any reason. In this situation the integrity of the desired color scheme and style will be maintained, and the substituted florals chosen will be of equivalent or higher value.

Perishable Products

You must understand that fresh florals are perishable items. While Larkspur & Leo will make every effort to preserve all fresh florals for the duration of your event, environmental conditions may be beyond our control. Additionally, flowers are sensitive to excessive heat, direct sunlight, lack of water, and various other conditions. Larkspur & Leo will not be held responsible for any wilting or damage resulting from environmental conditions occurring after the completion of delivery and set-up.

Non-Floral Rental Items

All rental items are required to be in the possession of Larkspur & Leo by 3:00pm the next business day following your event date, unless otherwise agreed upon. If rental items are not returned, or deemed unreturnable, due to damage, theft, or otherwise, you will be charged the full replacement price of each rental item not returned. The replacement price will be listed under each applicable rental item description within the rental item contract agreement, which will be emailed to you for review and acceptance following the final consultation, or within 30 days of your event date. Certain exceptions may apply, but only at the discretion of Larkspur & Leo.

Major credit or debit card information, in the name of the renter, will be required to rent any non-floral decor items from Larkspur & Leo. Authorization to charge said credit or debit card the applicable cost of non-returnable rental items is required. Your credit or debit card will not be charged unless any rental items are not returned or deemed unreturnable, as previously stated. 

Personal & Third Party Property

Any personal items provided by you, a family or friend, an associate, or a third party vendor (i.e. wedding planner, coordinator, or decorator), to be used as props, décor, or floral containers, must be delivered to Larkspur & Leo no later than one week (seven days) prior to your event date. Said items must also be delivered in the condition you would like them to be used (e.g. cleaned, polished, free of tags or debris, etc.). You understand that submitting your own personal property is at your own risk, and Larkspur & Leo will not be held liable for any loss or damage that incurs while in possession of said items, nor upon delivery and setup.

Larkspur & Leo will not be held liable for any loss or damage to venue-provided décor items that may incur during setup, which includes but is not limited to ceremony arches, chuppahs, vases / containers, candles / lanterns, chairs, tables, chandeliers, fireplace mantles, or any other item or structure not supplied by Larkspur & Leo. You must agree to indemnify, defend, and hold harmless all affiliates of Larkspur & Leo for any injury, property damage, liability, claim, or other cause of action arising out of, or related to, the floral design and décor services and products provided by Larkspur & Leo.

Grab-n-Go Floral

Larkspur & Leo is happy to offer the sale of Grab-n-Go fresh floral items for you to use at your discretion. Grab-n-Go floral items are packaged by their growers and will require appropriate care and storage for best results. Although we will provide exterior inspection to each item upon receipt, we will not open the packaging, therefore purchasing said Grab-n-Go floral items is at your own risk, and Larkspur & Leo will not be held responsible for the quality, quantity, appearance, and longevity of each stem once the bunch is in your possession. A general description of floral items will be listed within the proposed design plans, which will include an approximate bunch quantity and general care guidelines.

Artistic Liberty

You must understand, and agree, that you are booking Larkspur & Leo based on previous floral stylings, portfolios, and executions. Every reasonable effort is made to arrange floral pieces to your liking but we cannot promise exact floral arrangements due to the unique nature of flowers and floristry. By commissioning Larkspur & Leo to design and create florals for your event, you entrust the artists and representatives to utilize their design skills and capabilities shown during consultations and other events. Therefore, you authorize Larkspur & Leo to choose all floral varieties, color schemes, and textures that will best showcase the event's ideas. By signing this agreement you are allowing Larkspur & Leo full Artistic License to create distinctive and unique floral pieces and tablescapes for your event.

Exclusivity & Artistic Integrity

Larkspur & Leo is committed to providing floral and décor design services that are cohesive, fitting of your desired event style or theme, and of the highest quality. Therefore, Larkspur & Leo requires complete exclusivity on these services for your event, with the exception of the setup and decorating assistance, of any items NOT provided by Larkspur & Leo, by a third party planner, coordinator, assistant, or family member / friend. DIY floral arrangements, provided by you, your venue, a family member / friend, or third party vendor, may be permitted at the discretion of Larkspur & Leo.

 

Any images of floral or décor, NOT provided by Larkspur & Leo, that are publicly shared, are not to be attached to the Larkspur & Leo name, business address, website, or social media accounts. Alternatively, any images of floral or décor provided by Larkspur & Leo, that are shared on a public forum, must be credited to Larkspur & Leo.

 

These terms are for the purpose of protecting the integrity and public image of Larkspur & Leo. Should these terms be breached without prior communication and approval, Larkspur & Leo reserves the right to be excused from providing floral and décor services, and all monies paid will be forfeited. Certain exceptions may apply at the discretion of Larkspur & Leo.

Photography & Permitted Uses

You must agree that Larkspur & Leo may use any images from this event for our portfolio, advertising, website, blog, magazine submissions, and other promotional means. You agree to waive the right to inspect or approve the finished product, including a written or electronic copy, wherein Larkspur & Leo's likeness appears. Larkspur & Leo is held harmless and released from all claims, demands, and causes of action which Larkspur & Leo, its heirs, representatives, executors, administrators, or any other persons acting on your behalf or behalf of your estates have or may have because of this authorization.

Cancellations & Postponements

Because all floral items are custom-made, and require advance preparation, orders may only be canceled thirty (30) days or more prior to your event date, in which case a full refund on all unutilized monies paid (less the non-refundable $500 retainer payment) will be remitted. Orders may be postponed thirty (30) days or more prior to your event date, at no penalty; a specific postponement date will be required for approval and scheduling. For orders canceled or postponed within thirty (30) days prior to your event date all monies paid will be forfeited. Certain exceptions may apply, but only at the discretion of Larkspur & Leo.

Inclement Weather

Larkspur & Leo reserves the right to make any changes based on the weather for outdoor events, i.e., heat, rain, snow, etc. You must agree that it is your responsibility to be aware of changing weather conditions and protect the event's party, guests, and other persons. We reserve the right not to work if conditions on site, equipment, weather, et al. would jeopardize any person's safety. We will contact you immediately should such a situation occur and do everything in our power to come up with an equally satisfactory resolution.

Force Majeure & Impossibility

In the event of any disastrous occurrence, outside the control of either yourself or Larkspur & Leo (e.g. natural disaster, war / terrorism, environmental hazard, etc.), either party may be excused of any further obligations to this service agreement and any monies paid will be remitted.

 

In the event of any other occurrence, in which Larkspur & Leo is unable to fulfill the floral & décor services outlined in the design plan, you will be notified immediately and any monies paid will be promptly remitted.

Larkspur & Leo's Commitment to You

It is Larkspur & Leo’s policy to submit a floral & décor design plan and contract agreement for review and acceptance within thirty (30) business days from the date of consultation. It is important to note that the design plan is a working document, and is subject to change at any time, which includes, but is not limited to, pricing and substitutions. The initial, proposed total cost provided is to be considered a "rough" estimate since the overall event design, amount of floral and décor items needed, pricing, and floral availability may change from the time of consultation to the event date.

 

Upon booking Larkspur & Leo as your event floral and décor designer, the commitment to you includes the following: to provide thorough consultation - to learn and understand, to the full extent, your desired theme, colors, style, floral and décor preferences, and budget; to provide realistic expectations and clear communication for timelines, costs/budget, and floral availability; to provide immediate communication in the event of any needs for major floral substitutions, and/or order modifications, additions, or cancellations; to provide clear and consistent communication regarding total costs, as they are subject to change from the time of consultation to the time of receipt; to treat you with the utmost respect at all times; and, to uphold as much enthusiasm for your event as we would our own.

Your Commitment to Larkspur & Leo

In return, the expected commitment from you is as follows: to provide clear communication regarding your desired theme, colors, style, floral and décor preferences, and budget; clear and immediate communication regarding any desired modifications, additions, or cancellations to your order, and within the aforementioned timeframes; prompt payment by or before the aforementioned due dates; to treat our design team with the utmost respect at all times; the understanding that the event floral and décor design plan is a working document, and is subject to change at any time; and, to comply with the terms and conditions of this contract agreement.
